ASABA—THE Court of Appeal sitting in Benin City, Edo State, Tuesday, upheld the election of Mr Monday Igbuya, Delta State House of Assembly member representing Sapele constituency.
The appellate court, agreed with the ruling of the Election Petition Tribunal, Asaba, which upheld Igbuya’s election, who is the Speaker of the House.
The court awarded cost of N100, 000 against the petitioners.
The All Progressives Congress, APC, candidate for the House of Assembly election for Sapele constituency, Chief Felix Anirah, had approached the Appeal Court, urging it to set aside the judgment of the Asaba tribunal, which earlier affirmed Igbuya’s victory.
He asked the court to declare him winner having allegedly scored the highest lawful votes cast.
The Appeal Court said, “The petitioner failed to prove his case of substantial non- compliance to the Electoral Act.”
